1. Introduction and Acceptance of Terms

Welcome to ExchangeInstant. By accessing or using our website, API, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you ("User") and ExchangeInstant FZ-LLC ("Company," "we," "us," or "our"), a company registered in Dubai, UAE. If you do not agree to any part of these Terms, you must immediately discontinue use of the Services.

2. Description of Services

ExchangeInstant provides a non-custodial cryptocurrency exchange platform. We act as an interface that allows users to convert one digital asset (such as Bitcoin or USDT) into another digital asset or fiat currency equivalent (such as PayPal USD) via automated liquidity providers.

  • Non-Custodial Nature: We do not store, hold, or act as a custodian for your funds. We do not maintain user wallets or private keys.

  • Automation: Our services are automated. Transactions are processed programmatically based on the instructions you provide.

3. Eligibility

By using our Services, you represent and warrant that:

  1. Age: You are at least 18 years old or of legal age to form a binding contract under applicable law.

  2. Capacity: You have the full power and authority to enter into this agreement.

  3. Jurisdiction: You are not located in, or a resident of, any country subject to international financial sanctions (including but not limited to North Korea, Iran, Cuba, Syria, or the Crimea region).

  4. Legality: Your use of the Service does not violate any laws or regulations applicable to you, including anti-money laundering (AML) and counter-terrorism financing (CTF) laws.

4. Anti-Money Laundering (AML) & KYC Policy

While ExchangeInstant prioritizes privacy and does not require identity verification ("No KYC") for standard low-volume transactions, we are committed to preventing financial crime.

  • Automated Monitoring: We utilize automated risk analysis tools to screen incoming transactions.

  • High-Risk Transactions: If a transaction is flagged as "High Risk" (e.g., funds originating from darknet markets, mixers, or known stolen wallets), we reserve the right to pause the transaction. In such cases, we may require you to provide proof of ownership or identity before funds are released or refunded.

  • Prohibited Activity: You agree not to use our platform for money laundering, illegal gambling, fraud, or the financing of terrorism.

5. Exchange Rates and Fees

  • Dynamic Rates: Cryptocurrency prices are highly volatile. The exchange rate displayed at the start of your transaction is an estimate. The final rate is locked only when your deposit receives the required number of confirmations on the blockchain (typically 1 confirmation for Bitcoin).

  • Network Fees: You are responsible for paying all network fees (miner fees) required to send your funds to us.

  • Service Fees: Our service fee is transparently included in the "You Receive" amount shown to you during the checkout process. There are no hidden charges.

6. Transactions and Refunds

  • Irreversibility: Blockchain transactions are immutable. Once you send cryptocurrency to our wallet address, the action cannot be undone. Once we send fiat funds (e.g., to your PayPal account), the transaction is final.

  • Incorrect Details: You are solely responsible for providing the correct payout details (e.g., PayPal email address). We are not liable for funds sent to the wrong account due to user error.

  • Refund Policy: Refunds are generally not provided for completed transactions. However, if a technical error on our side prevents the payout, or if you accidentally send an unsupported token that is recoverable, we may issue a refund at our discretion. All refunds are subject to a processing fee to cover network costs.

7. Limitation of Liability

To the maximum extent permitted by law, ExchangeInstant shall not be liable for:

  1. Any indirect, incidental, special, consequential, or punitive damages.

  2. Loss of profits, data, use, or goodwill.

  3. Service interruptions, server downtime, or blockchain network congestion.

  4. Losses resulting from hacking, tampering, or other unauthorized access to your personal devices or data.

Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount of fees paid by you to us in the transaction giving rise to the claim.

8. Risks of Cryptocurrency

You acknowledge that trading and exchanging cryptocurrencies involves significant risk. Prices can fluctuate wildly at any moment. You accept full responsibility for any financial losses resulting from market volatility or the use of our Services.
